Limited Warranty Policy

1.          Warranty and Australian Consumer Law

(a)        This Limited Warranty Policy (“Warranty”) is provided by Navimow (Hong Kong) Trading Limited (“we”, “us” or “our”). This Warranty is provided in addition to, and does not limit, exclude or replace, any rights you have under the Australian Consumer Law (“ACL”) and the Competition and Consumer Act 2010 (Cth).

(b)        Our products come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

(c)        Where you are a consumer within the meaning of the ACL, your remedies for a failure to comply with consumer guarantees are set by the ACL and may include repair, replacement, refund, cancellation and/or compensation, depending on whether the failure is major or not.

2.          What this Warranty covers

(a)        Subject to section 6, we warrant that the products listed in section 4 (Product” or “Products”) will be free from defects in materials and workmanship under normal domestic use and in accordance with the user manuals, safety instructions and maintenance requirements, for the applicable warranty period (“Warranty Period”).

(b)        If a Product has a defect covered by this Warranty during the Warranty Period, we will, at our option and subject to the ACL, repair the Product, replace the Product or the defective component with a new or refurbished equivalent, or provide another remedy permitted by law.

3.          Who this Warranty is for

(a)        This Warranty applies to the original enduser purchaser of a Product purchased in Australia from us or an authorised Navimow dealer (“Authorised Dealer”) and used in Australia. Where permitted by law, and subject to proof of purchase, we may allow a subsequent owner to claim under this Warranty for the remainder of the Warranty Period.

4.          Warranty periods by Product

The Warranty Period begins on the date of the original retail purchase shown on your proof of purchase (“Purchase Date”).

The Warranty Periods below apply unless required otherwise by the ACL.

5.          How to make a Warranty claim

(a)        To make a claim, stop using the Product if continued use may cause injury, damage or further faults, and contact our support team using the details in section 13.

(b)        Please be ready to provide:

                             (i)         proof of purchase such as tax invoice or receipt showing the Purchase Date;

                            (ii)         Product model and serial number;

                           (iii)         a clear description of the issue, including when it occurs and any error messages; and

                          (iv)         photos or videos (where relevant) and any troubleshooting steps already taken.

(c)        Assessment and service process

                            (i)           We may ask you to perform reasonable diagnostic steps including software updates or checks described in the user manual and/or to return the Product or the relevant component to an authorised service centre for assessment.

                          (ii)           If the issue is covered by this Warranty, we will arrange for a remedy as set out in section 2. If the issue is not covered, we will inform you of any inspection, repair and shipping costs before proceeding.

(d)        Subject to your Nonexcludable Rights under the ACL:

                           (i)           If the issue is a minor failure, we may require you to pay the initial shipping or delivery cost to the nominated service centre. If the fault is confirmed to be covered by this Warranty, we will reimburse reasonable shipping costs and pay the cost of returning the Product to you.

                          (ii)           If the issue is a major failure, you may have rights under the ACL to a refund or replacement and to recover reasonably foreseeable loss or damage. We will work with you to provide the appropriate remedy in accordance with the ACL.

                         (iii)           We may use refurbished parts or refurbished goods of the same type for repair or replacement.

6.          Eligibility and exclusions

(a)        This Warranty applies only if:

                           (i)           the claim is made within the applicable Warranty Period;

                          (ii)           the Product was purchased in Australia from us or an Authorised Dealer;

                         (iii)           you provide valid proof of purchase; and

                         (iv)           the Product serial number is intact and legible.

(b)         To the extent permitted by law, this Warranty does not cover defects, failures or damage caused by or resulting from:

                           (i)       accident, abuse, misuse, neglect, improper handling or improper transport;

                          (ii)        use other than normal domestic use, or use inconsistent with the user manuals, safety instructions or maintenance requirements;

                         (iii)        installation errors (including boundary/antenna placement or setup) not performed in accordance with instructions;

                         (iv)       improper charging, storage, cleaning, maintenance, or use with unsuitable power supply;

                          (v)       unauthorised modification, tampering or repair by a person other than an authorised service provider;

                         (vi)       use of nonapproved accessories, consumables, parts, batteries or software;

                       (vii)        external causes such as power surges, lightning, flood, fire, pests, or other environmental conditions outside normal operating parameters;

                      (viii)        normal wear and tear, consumables and cosmetic damage that does not affect functionality (for example, scratches, dents, discolouration);

                         (ix)       loss of data, settings or configurations (you should back up and record settings where applicable); and

                          (x)       products with removed, altered or illegible serial numbers.

This Warranty does not cover incidental costs such as lawn restoration, thirdparty installation fees, or loss of time, except to the extent such costs are recoverable under the ACL.

7.          Liability and limitation

(a)        Subject to your right or remedy that cannot lawfully be excluded (“nonexcludable rights”), and to the maximum extent permitted by law, our liability under this Warranty is limited to the remedies described in section 2.

(b)        To the maximum extent permitted by law and subject to your Nonexcludable Rights, we are not liable for any indirect or consequential loss including loss of profit, loss of revenue, loss of goodwill, or loss of data arising out of or in connection with a Product or this Warranty.

(c)        Nothing in this Warranty limits or excludes liability for:

                               (i)       breach of Nonexcludable Rights;

                              (ii)        death or personal injury caused by negligence;

                             (iii)       fraud; or

                            (iv)       any other liability that cannot be excluded by law.

8.      Repair notice (refurbished products)

Products presented for repair may be replaced by refurbished products of the same type rather than being repaired. Refurbished parts may be used to repair the Products.

9.       Privacy

We collect and handle personal information to assess and process warranty claims (e.g., your contact details, proof of purchase, and information about the Product and fault). We handle this information in accordance with our Privacy Policy and applicable privacy laws. We may disclose relevant information to our service partners and logistics providers to provide warranty services.

10.     Governing law and dispute resolution

(a)        This Warranty is governed by the laws of Queensland, Australia. You and we submit to the nonexclusive jurisdiction of the courts of Queensland, Australia.

(b)        If you have a dispute or complaint, please contact us first and we will try to resolve it promptly and fairly. Nothing in this section limits your right to seek assistance from Australian consumer protection agencies or to bring proceedings in a court where you are entitled to do so.

(c)        Any dispute, controversy, difference or claim arising out of or relating to these Terms, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non- contractual obligations arising out of or relating to it shall be referred to and finally resolved by arbitration administered by China International Economic and Trade Arbitration Commission (CIETAC) in accordance with its rules of in effect at the time of applying for arbitration. The place of arbitration shall be Beijing. Both Parties further acknowledge and confirm that the arbitral award shall be final and binding upon all Parties, not subject to any appeal; and shall deal with the question of costs of arbitration and all matters related thereto. Enforcement of the award rendered by the arbitrators may be entered into by any court having jurisdiction thereof.

11.       Severability

If any provision of this Limited Warranty is found unenforceable, the remaining provisions shall remain in effect.

12.       Language

This Limited Warranty may be translated into other languages. In the event of a conflict, the English version shall prevail.

13.       Contact Information
